The prosecution

The Prosecutor is an organ of justice. Prosecutors are not elected here, they are civil servants in general, and therefore need not prove - as in the U.S. - a number of convictions. To determine the contrary, they have both incriminating and exonerating facts. In many cases in which someone is accused of a crime, it comes in from the front not on the indictment. Either it turns out that the person is innocent, or there is at least a significant doubt about his guilt.

Here in Germany there is the presumption of innocence: Someone is innocent until he has not clearly demonstrated the opposite - and the latter is only after a closed trial of the case! Many investigations are set in. But also because of insignificance from the front and not brought to trial. If the prosecutor at the conclusion of its investigation to the conclusion that the accused has committed a crime, it has two options: either it accuses him and there is a judicial procedure. In mild cases (often in traffic matters such as driving without a license or hit and run) but they often requested the court to issue a so-called penalty order.

Then a penalty is imposed without a hearing. The recipient accepts, he is indeed a criminal record, but must not appear in court - which relieves all parties. It contradicts the other hand, there is a trial. The prosecutor, moreover, in the retrial. And so there are divisions, the more people get out of jail when she hineinbringen.
